In a letter addressed to the Attorney-General of the Federation and Minister of Justice, Lateef Fagbemi (SAN), the NLC affirmed its commitment to holding the scheduled protests on Tuesday and Wednesday as originally planned.

The decision comes amid earlier assertions from the federal government questioning the legality of the NLC’s proposed protest and warning against its execution.

In response, the NLC, represented by its lawyer, Femi Falana (SAN), emphasized that the fundamental rights of freedom of assembly and expression allow for peaceful protests, which cannot be curtailed by purported court orders.

The letter, titled “MEMORANDUM OF UNDERSTANDING REACHED BETWEEN THE FEDERAL GOVERNMENT OF NIGERIA AND THE TRADE UNION CONGRESS (TUC) AS A RESULT OF DISPUTE ARISING FROM WITHDRAWAL OF SUBSIDY ON THE PRICE OF PREMIUM MOTOR SPIRIT (PMS) ON MONDAY THE 2ND DAY OF OCTOBER, 2023,” outlines the sequence of events leading to the planned protests and the legal challenges encountered.

While acknowledging previous legal proceedings initiated by the federal government, the NLC emphasized its right to challenge the jurisdiction of the National Industrial Court and reiterated its commitment to peaceful demonstrations.

Furthermore, the NLC urged the Attorney-General to ensure adequate security measures are put in place to safeguard the participants during the protests, citing provisions of the Police Establishment Act 2020.

In conclusion, the NLC expressed confidence in the democratic rights of Nigerian citizens to engage in peaceful protests, urging the authorities to uphold these rights and provide necessary security arrangements for the planned demonstrations.

Utomi highlighted that other aspirants, including Chibuike Amaechi and Mohammed Hayatu-deen, had rejected the primary results and lodged complaints. Consequently, Utomi described Obi’s exit as a strategic and intelligent decision.

Regarding the broader political landscape, Utomi remarked:

  • While polling indicated that Obi would have won within the ADC, the prospect of the party leadership permitting a transparent process was doubtful.

  • He argued that the general management of primary processes across the political spectrum renders them a “complete farce”.
