Justice Stephen Dalyop Pam delivered the ruling on Friday, saying the case lacked merit and evidence strong enough to compel Ibas to make any repayment to the state.

The suit was filed by a group of Rivers residents who claimed that funds belonging to the state were wrongly expended during Ibas’ tenure as a senior military officer. They argued that the money should be returned because it was not used for the benefit of the people of Rivers.

But the court ruled that the plaintiffs failed to prove their claims. Justice Pam stated that the allegations were not supported by credible documents or facts. He explained that a refund order could not be made based only on suspicion or general accusations.

“The plaintiffs have not placed before this court any concrete evidence to show that the defendant received or misapplied monies belonging to Rivers State,” Justice Pam said. “Mere allegations without proof cannot stand in law.”

The judgment brings an end to months of legal battle that had drawn attention in Rivers, a state already facing political and financial disputes. Observers had seen the case as a test of how far citizens can push claims of misused public funds against powerful former officials.

Ibas, who served as Chief of Naval Staff between 2015 and 2021, was not in court during the ruling. The plaintiffs, however, expressed disappointment. Speaking outside the courtroom, one of their lawyers said they would study the judgment carefully before deciding on an appeal. “We believe that public funds must be accounted for, and we will not stop pursuing justice for the people of Rivers State,” he said.

The Rivers State government did not officially join the suit but closely monitored the proceedings. Government sources had earlier indicated interest in seeing accountability for state resources but chose not to intervene directly in the legal process.

The case comes at a time when Rivers State politics is deeply divided, with rival camps trading accusations of corruption and misuse of public funds. While the dismissal may calm one legal battle, it is unlikely to end broader debates about accountability and governance in the oil-rich state.

For now, Vice Admiral Ibas walks free of the refund claims, while the plaintiffs weigh their next steps. If they appeal, the case could move to the Court of Appeal in Port Harcourt in the coming months.
