In a statement issued by AON President Dr. Abdulmunaf Sarina in Lagos, the organization commended the court’s decisive action. Sarina emphasized that the court’s ruling exposed the sale as a deceptive scheme intended to undermine Nigerian airlines and transfer the country’s substantial aviation market, which includes over 85 bilateral air service agreements, to Ethiopian Airlines.

Sarina expressed gratitude to the court for resisting significant pressure and for protecting the interests of Nigerian airlines. He also acknowledged President Bola Tinubu’s administration and Aviation Minister Festus Keyamo SAN for halting the Nigeria Air sale process.

The court’s judgment highlighted that the sale of Nigeria Air violated several key regulations, including the Companies and Allied Matters Act 2020, the Securities and Exchange Commission Nigeria Consolidated Rules & Regulations 2013 (amended in 2022), and other relevant laws such as the Nigerian Investment Promotion Commission Act, ICAQ Convention, Civil Aviation Act, and Public Procurement Act.

Justice Lewis-Allagoa ruled that the bidding and selection processes were flawed and that Ethiopian Airlines was not eligible to acquire shares in Nigeria Air. The court ordered the immediate revocation of the Air Transport License issued to Nigeria Air Ltd. and issued a perpetual injunction to prevent any further attempts to transfer the operations to Ethiopian Airlines

Background on Conviction

Bolarinwa has been serving a prison sentence following his initial remand in April 2022 by the Economic and Financial Crimes Commission (EFCC).

  • He was arraigned before Justice Oluwatoyin Taiwo of the Special Offences Court in Ikeja on a 13-count charge encompassing forgery, possession of false documents, and obtaining money by false pretences amounting to ₦266.5 million.

  • The EFCC stated that Bolarinwa deceived Kodef Clearing Resources Limited by posing as a military general and claiming that former President Muhammadu Buhari had shortlisted him for appointment as Chief of Army Staff, extracting large sums to “facilitate” the role.

  • Investigators also recovered forged appointment letters, military identification cards, recommendations bearing former President Olusegun Obasanjo’s name, and several firearms from his Alagbado residence.

  • Although he initially pleaded not guilty, Bolarinwa changed his plea to “guilty” during court proceedings on July 7, 2022.

  • Justice Taiwo convicted him on all 13 counts, sentencing him to seven years’ imprisonment without the option of a fine, ordering asset forfeitures, and directing him to pay ₦20 million in restitution.
