Court Cracks Down: Agballah And Nine APC Officials Barred From Party Leadership In EnuguA High Court in Enugu State has issued an injunction prohibiting Barr Ugochukwu Agballah from acting as the chairman of the All Progressives Congress (APC) in the state. Alongside Agballah, the court order also bars the following individuals from holding any party positions: Deputy Chairman Chief Augustine Alumonah, Mr. Jude Chinedu Aniogbo, Mr. Moses Emeka Eze, Barr. Sunday Ugwoke, Mr. Ugwu Christian Kanayo, Mr. Eze Chidiebere Johnson, Queen Charles, Onyekachi T. Ezeagu, and Comrade Idoko Chikadibia.
The lawsuit, identified as NO: E/548/2024, was filed before Hon. Justice C.V.C. Ezeugwu. The plaintiffs include Nwafor Alphonsus Onyeachonam, Acting State Chairman of APC Enugu State, Chief Michael Ezeanyawu, State Publicity Secretary, Comrade Peter Chime, State Youth Leader, Mr. Uba Uthman Onah (Chairman Forum Of L.G Chairmen), and Comrade Samuel Okonkwo (Chairman Forum Of L.G Secretaries), representing the APC State Executive Committee in Enugu State.
The court document outlines the following interim orders:
- Restriction of Roles: The court has barred the 1st to 10th Respondents from acting as state party officials, including positions such as State Party Chairman, Deputy Chairman, Treasurer, and other key roles. This ban remains in effect until the Motion on Notice is heard on August 13, 2024.
- Meeting and Activities Prohibition: The 1st to 10th Respondents are prohibited from organizing or holding any party meetings, congresses, or conventions, and from interfering with the activities of the legitimate APC State Executive Committee in Enugu State.
- Account and Property Restrictions: The 1st to 10th Respondents are restrained from accessing or dealing with the APC Enugu State Party account and the party’s secretariat located at No. 598 Bishop Onyeabor Street, G.R.A, Enugu North Local Government Area. The court has also directed that the 11th Respondent, UNEC Branch, Enugu, should not honor any instructions from the barred individuals concerning the party account.
- Service of Orders: The court has authorized the plaintiffs to serve the court orders and other related processes to the 1st to 10th Respondents via substituted means, such as posting at the APC Enugu Chapter Secretariat.
