SERAP Demands CBN Explain Missing ₦100 Billion In ‘Dirty Notes’The Socio-Economic Rights and Accountability Project (SERAP) has challenged the Central Bank of Nigeria (CBN) to account for over ₦100 billion in ‘dirty and bad notes’ and other large sums of cash awaiting examination stored in various branches of the apex bank. SERAP criticized the CBN for failing to disclose the location of these funds. Kolawole Oluwadare, the group’s deputy director, revealed that SERAP has approached the Federal High Court in Lagos, seeking an order to compel the CBN to explain the whereabouts of the ₦100 billion in dirty and bad notes that have been kept in various CBN branches since 2017.

SERAP also requests that the court direct the CBN to account for ₦7.2 billion meant for constructing the CBN Dutse branch building in 2010 and ₦4.8 billion intended for renovating the CBN Abeokuta branch in 2009. Additionally, SERAP wants the CBN to publish the names of the contractors who received these funds.

The group further demands explanations for the allegedly missing loans, including ₦1.2 billion granted to the Enugu State government in 2015 and ₦1.9 billion granted to the Anambra State government between 2015 and 2016.

SERAP argues that revealing the whereabouts of the missing public funds, publishing the names of those suspected to be responsible, ensuring they are brought to justice, and recovering any missing public funds would serve the public interest and end the impunity of the perpetrators.

The lawsuit, filed on behalf of SERAP by lawyers Kolawole Oluwadare and Adelanke Aremo, states: “Nigerians have the right to know the whereabouts of the public funds. Granting the reliefs sought would advance the right of Nigerians to restitution, compensation, and guarantee of non-repetition.”

The lawsuit also references Paragraph 708 of the Financial Regulations 2009, which stipulates that payment should not be made for services not yet performed or goods not yet supplied, and Section 35(2) of the Public Procurement Act 2007, which requires an interim performance certificate before any further payments are made to suppliers or contractors who have received a mobilization fee
