In a statement released on Thursday, SERAP Deputy Director, Kolawole Oluwadare, condemned Fagbemi’s remarks made during the opening session of the ECOWAS judicial council meeting in Abuja, where he cast doubt on the enforceability of judgments delivered by the ECOWAS Court. SERAP emphasized that such comments are contrary to Nigeria’s international legal obligations under ECOWAS treaties and protocols.
The organization underscored the importance of upholding the authority and integrity of the ECOWAS Court, stressing that its judgments are binding and enforceable, similar to those of Nigerian courts. It cautioned against undermining the credibility of the ECOWAS Court, which could impede access to justice and effective remedies for Nigerians.
SERAP urged President Tinubu, as the chairman of ECOWAS, to demonstrate leadership by promoting the implementation of ECOWAS treaties and protocols, rather than disparaging the court. It highlighted the critical role of ECOWAS Court judgments in realizing the organization’s objectives and fostering regional cooperation.
Moreover, SERAP emphasized Nigeria’s obligation to enforce decisions of the ECOWAS Court, including judgments that uphold fundamental human rights and hold the government accountable for violations. It called for immediate action to implement outstanding judgments, such as ensuring free education for all Nigerian children and compensating victims of human rights abuses.
