Court Of Appeal Slams Daddy Freeze With ₦5 Million Adultery Fine: Appeal Dismissed!
The fine was originally imposed by the High Court in Port Harcourt on February 18, 2021, following Daddy Freeze’s affair with Benedicta Elechi, who was married to Paul Odekina at the time. The appellate court’s ruling stated, “The sum of ₦5,000,000 is awarded against Ifedayo Olarinde as damages for depriving the plaintiff of the companionship of his wife and for the injury suffered as a result of the affair.”
The court also annulled the marriage between Paul and Benedicta due to the adulterous relationship.
Daddy Freeze appealed the decision, arguing that the initial court proceedings were flawed due to improper service of notice. He claimed the substituted service by courier was ineffective and violated natural justice principles.
However, the three-judge panel, comprising Justices Abubakar Talba, Danlami Senchi, and Hannatu Balogun, dismissed the appeal on June 26, 2024. The judges found the appeal lacked merit, stating that Daddy Freeze should have contested the affidavit of service at the trial court rather than appealing the judgment.
The ruling affirmed the original judgment delivered by Justice Akpughunum on February 18, 2021, with no costs awarded.
Ola Faro and Ikobah Hilton represented Daddy Freeze, while N.A. Naenwi and Wilcox Abereton (SAN) represented the respondents.
