Justice Inyang Ekwo of the Federal High Court in Abuja has dismissed a preliminary objection filed by former Anambra State Governor, Willie Obiano, against fraud charges amounting to N4 billion in security votes brought by the Economic and Financial Crimes Commission (EFCC).

The court ruling on Thursday rejected Obiano’s motion aimed at inhibiting the EFCC from exercising its powers under its founding Act. Justice Ekwo clarified that the ex-governor’s security votes, sourced from Nigeria’s federation account, fall under the jurisdiction of the EFCC for investigation.

Represented by Senior Advocate of Nigeria, Sylvanus Tahir, the EFCC argued against Obiano’s motion last month, asserting that the investigation extends beyond the Security Votes Accounts to encompass a comprehensive review of Anambra State’s financial activities from 2014 to 2022.

Obiano, through his lawyer, Onyechi Ikpeazu SAN, filed a motion seeking to squash the charges, arguing that there was no evidence linking him to the alleged disbursement of security votes and other state funds. Ikpeazu also referenced an appeal filed by the Anambra State government challenging the EFCC’s authority to investigate security votes.

In his ruling, Justice Ekwo dismissed Obiano’s application, stating that the Federal High Court operates under summary jurisdiction in criminal proceedings, exempting the need for proof of evidence prior to trial. He also upheld the EFCC’s powers, noting that the matter involves constitutional issues regarding state security votes sourced from the federation account.

The judge concluded by dismissing Obiano’s objection and granted a request to vary the bail conditions to allow the defendant to travel. The trial is scheduled to commence on June 24.

Obiano faces allegations of financial impropriety during his tenure as governor, with the EFCC pursuing charges related to the misappropriation of security votes and other financial irregularities.
