The Court of Appeal in Abuja has rejected a request to compel the Code of Conduct Bureau (CCB) to disclose the assets declared by former presidents, vice presidents, and principal officers of the National Assembly. The organizations had taken the CCB and its chairman to the Federal Capital Territory High Court after their request under the Freedom of Information Act was denied. However, their suit was dismissed by the high court.
In a unanimous decision, a three-member panel of justices dismissed the appeals filed by the two non-governmental organizations. PPDC had specifically requested the asset declaration forms of former president Goodluck Jonathan, his vice Namadi Sambo, ex-president Muhammadu Buhari, his vice Yemi Osinbajo, and former principal officers of the National Assembly.
Justice Okon Abang, delivering the verdict, stated that the appellants had failed to fulfill the necessary conditions for the release of such information to them. He described their application as premature and emphasized the necessity for them to first mandate the National Assembly to set forth the terms and conditions for the public before approaching the CCB.
Furthermore, Justice Abang highlighted that the provisions of the Freedom of Information Act did not align with the relevant sections of the 1999 Constitution, as amended. He stated that the Constitution supersedes any provision of the FOI Act that is inconsistent with it.
Consequently, the appellate court dismissed the appeal and awarded a cost of N200,000 each against the appellants.
