FCT Court Orders INEC To Publish ADC Candidates’ Names.
An Abuja Federal High Court on Tuesday directed the Independent National Electoral Commission (INEC) to publish the names of candidates submitted by the African Democratic Congress (ADC) for the February 21 Area Council elections in the Federal Capital Territory.....KINDLY READ THE FULL STORY HERE▶
The order was given by Justice Mohammed Umar in a suit filed by 17 ADC candidates who challenged INEC’s refusal to grant the party electronic access to upload their details for the polls.
The suit, FHC/ABJ/CS/1907/25, arose after INEC allegedly failed to recognize the list submitted by ADC under its chairman, David Mark.
In his ruling, Justice Umar found the plaintiffs’ evidence credible and deserving of probative value, holding that they had proven their case beyond reasonable doubt.
“The evidence provided by the plaintiffs was credible enough for the court to attach a more probative value,” the judge said, granting all reliefs sought in the originating summons.
Consequently, INEC was ordered to recognize and publish the names of the plaintiffs as ADC candidates for positions contested in the party’s substitution primary election. The commission was also directed to grant the ADC electronic access to upload the candidates’ names on its portal, citing Sections 29(1), 31, 33, and 84(1)(5)(6) of the Electoral Act 2022 and INEC guidelines.
The candidates listed for upload include Jafaru Shaibu, Ayenajeyi Yakubu, Dauda Awode, Ezra Zaki, Sunday Abraham, Ayuba Adam, Jamilu Kabiru, Nuhu Madaki, Ibrahim Aliyu, Ogwuche Linus, as well as Chibuike Anyika, Okechukwu Ironkwe, Godwin Adoga, Agada John, Onuoha Goodness, Mahrazu Bichi, and Tobias Obechina.
The plaintiffs explained in a 27-paragraph affidavit, deposed by Onuoha Goodness, that the first 16 plaintiffs emerged from the ADC primary election following the withdrawal of earlier candidates, while the 17th plaintiff was nominated as vice-chairmanship candidate for Abuja Municipal Area Council.
Goodness stated that although the party attempted to upload their details, INEC blocked access, citing issues with the substitution notification letter and failing to recognize signatures of the ADC’s current National Chairman and National Secretary, Rauf Aregbesola.
The plaintiffs also noted that INEC rejected a letter from their lawyer, Kalu Agu, requesting access for the ADC to upload their names, insisting the commission was determined to deny them portal access.
One of the key issues for determination was whether INEC, under the Electoral Act and its guidelines, was obliged to grant the ADC electronic access. Justice Umar resolved the matter in favor of the plaintiffs, ordering INEC to provide access and publish the candidates’ names ahead of the February 21 elections.
