Court Fines PDP N1.4M Over Delays in Kebbi Lawmakers’ Defection Case
The Federal High Court in Abuja has imposed a fine of N1.4 million on the Peoples Democratic Party (PDP) for causing repeated delays in a lawsuit regarding the defection of three members of the Kebbi State House of Assembly to the All Progressives Congress (APC).....KINDLY READ THE FULL STORY HERE▶
The case, filed in November 2024 (FHC/ABJ/CS/1389/2024), was lodged by the PDP, accusing Hon. Umar Na’amore, Hon. Hashimu Usman Hilinboro, Hon. Yusuf Abubakar Tilli, the Speaker of the Kebbi State House of Assembly, the Assembly itself, and the Independent National Electoral Commission (INEC) of unlawful actions related to the defections.
Initially, the PDP chose an Originating Summons procedure, typically used for straightforward cases, despite the complex nature of the allegations. The court expressed concerns over this approach, emphasizing that the matter warranted a more thorough examination. The PDP also requested multiple adjournments, citing lack of preparedness, further delaying proceedings.
On March 3, 2025, Justice Inyang Ekwo sanctioned the PDP, ordering them to pay N150,000 to each of the six defendants and N500,000 in administrative costs, totaling N1.4 million. The court emphasized the need for proper preparation by legal counsel and warned against further delays that would hinder justice.
During the next hearing on March 19, 2025, the PDP attempted to introduce new video evidence, but defense counsel opposed, arguing for a full trial with oral testimony and cross-examination. The court upheld the objection and ruled that the case could no longer proceed as an Originating Summons. Justice Ekwo instructed the PDP to file its pleadings within 14 days, as the nature of the case had changed due to the introduction of new evidence and fraud claims.
As of the report date, the PDP had not filed its Statement of Claim, despite the deadline expiring. The court is set to review the matter again on May 7, 2025.
