Renowned human rights lawyer and Senior Advocate of Nigeria, Femi Falana, has strongly criticized the increasing trend of charging protesters with treason in Nigeria. Speaking at an international anti-corruption and climate change conference in Abuja on Tuesday, Falana expressed grave concerns about what he termed the “tribalisation” of treason charges against citizens exercising their right to protest.

This statement follows the recent arraignment of 10 leaders and organizers of the #EndBadGovernance protest, which took place from August 1st to 10th, 2024. The Federal Government has accused the defendants of treason, among other serious charges. On Monday, they appeared before Justice Emeka Nwite of the Federal High Court in Abuja, where they all pleaded not guilty to the six-count charges brought against them by the Inspector-General of Police, Kayode Egbetokun.

The protesters, identified as Michael Adaramoye (also known as Lenin), Adeyemi Abayomi, Suleiman Yakubu, Opaoluwa Simon, Angel Innocent, Buhari Lawal, Mosiu Sadiq, Bashir Bello, Nuradeen Khamis, and Abdulsalam Zubairu, face allegations including treason, attempts to destabilize the country, intimidation of the President, and the destruction of government properties in Kano. The charge sheet marked FHC/ABJ/CR/454/2024 outlines these serious accusations, which have sparked widespread concern among human rights advocates.

Falana, known for his long history of defending individuals accused of treason, questioned the rationale behind labeling peaceful protesters as traitors. He revealed that he has been under significant pressure from both domestic and international communities over the last 24 hours, all expressing alarm over the situation. “How can you say that because people protested, they are being charged with treason?” Falana asked, highlighting the absurdity of the charges.

Assuring the public that there is no cause for alarm, Falana disclosed that he has already begun taking up the case and plans to advise the government, particularly President Bola Tinubu, to instruct the police to withdraw the charges. He emphasized that this advice is in the government’s best interest, noting that a treason charge is far more serious than a charge of theft.

“This will be the fifth treason charge I am going to defend in our country,” Falana stated, recalling previous instances where he successfully defended clients accused of treason, leading to the government withdrawing the charges. He warned that the misuse of treason charges could backfire on the government, just as it has in the past.
