The Federal Government has taken significant legal action against ten #EndBadGovernance protesters, who were arrested in various states, including Abuja, Kaduna, Kano, and Gombe. On Monday, the defendants appeared before a federal high court in Abuja, facing serious charges of treasonable felony, which could result in the death penalty, and allegations of a “plan to destabilize Nigeria.” Their court appearance occurred under tight security measures.
During the proceedings, the accused—identified as Michael Tobiloba Adaramoye (aka Lenin), Adeyemi Abiodun Abayomi (aka Yomi), Suleiman Yakubu, Comrade Opaluwa Eleojo Simeon, Angel Innocent, Buhari Lawal, Mosiu Sadiq, Bashir Bello (aka Murtala), Nuradeen Khamis, and Abdulsalam Zubairu—pleaded not guilty to the six counts presented against them.
The protesters have criticized the court order that led to their arrest and detention, asserting that President Bola Tinubu lacks the authority to arrest them. They have filed a suit marked FHC/ABJ/CS/1233/2024, challenging an August 22, 2024, Federal High Court order issued by Justice Emeka Nwite. This order had granted the Inspector General of Police the power to detain them for 60 days while investigations were ongoing.
In an affidavit submitted by Paul Ochayi, the protesters argued that their right to protest is protected under the law. They highlighted that President Tinubu himself had previously led protests without facing harassment or detention. The protesters contended that the actions of the security agencies pose a direct threat to their rights to life, dignity, health, and freedom of movement.
The applicants, led by human rights lawyer Femi Falana, filed a motion on notice on August 26, targeting the Inspector General of Police as the sole respondent. They argue that the ex parte motion allowing their remand was based on suppression and misrepresentation of key facts, labeling it a gross abuse of court processes. They are seeking the court to set aside the remand order and grant them bail.
