Justice Peter Lifu, in his ruling on a case initiated nine years ago, rejected the Abacha family’s demands for the return of their father’s mansions at Osara Close in Maitama and N500 million compensation.
The lawsuit, filed by Mohammed Sani Abacha and widow Hajia Maryam Abacha, representing the estate of the late military leader, named the Minister of the Federal Capital Territory, Federal Capital Development Authority, President of Nigeria, and Salamed Ventures Limited as defendants.
This latest dismissal marks the fourth consecutive legal defeat for the family over the property, having lost twice in the High Court of the Federal Capital Territory and once in the Abuja Court of Appeal on jurisdictional grounds.
The family had argued that the revocation of the Certificate of Occupancy for Plot 3119, issued in 1993 and revoked in 2006, violated constitutional and land use laws. They claimed the revocation lacked justification and adequate compensation.
However, Justice Lifu dismissed the case on several grounds, including that it was time-barred when filed in 2015 and that the plaintiffs lacked legal standing due to their failure to provide required letters of administration.
The judge concurred with arguments from Salamed Ventures Limited, the current property owner, that the revocation was lawful due to breaches of occupancy conditions. He ordered the Abacha family to pay N500,000 as legal costs to Salamed Ventures.
The Abacha family’s legal battles over the property continue amidst ongoing disputes and previous legal setbacks.”

The Allegation: The survivor, Malam Babawo Tudun Nasera—whose 17-year-old brother Salim was among the deceased—stated in a video that authorities wanted the miners to halt operations, but they continued working based on instructions allegedly given by Babangida.

The Arrest and Detention: Nasera explained that the miners went to the site to earn a living to feed their families before NSCDC personnel arrested them and held them in custody for three days, allegedly refusing release efforts.

Suspicious Circumstances: Raising questions about the sudden deaths, Nasera noted that the detainees had eaten well the day before, speculating that heat exposure or some form of administered substance may have been involved.

Lack of Verification: It remains unverified whether Babangida personally owns the operation, holds a mining license, or owns the land, as the NSCDC maintains that the miners were operating illegally.
