Yahaya Bello, the former Governor of Kogi State embroiled in legal proceedings with the Economic and Financial Crimes Commission (EFCC), disclosed his reasons for not appearing in the Federal High Court in Abuja to address the 19-count charge against him.

Despite his absence, Bello briefed a legal team to represent him during the court session on Tuesday.

Adeola Adedipe, SAN, a member of his legal team, conveyed Bello’s readiness to attend court proceedings but expressed concerns about a looming arrest warrant.

“The defendant wants to come to court but he is afraid that there is an order of arrest hanging on his head,” Adedipe, SAN, stated.

Consequently, the defense requested the court to revoke the ex parte arrest warrant issued against Bello, emphasizing that proper legal procedures for serving the charges had not been followed.

Moreover, Bello’s legal counsel argued that the EFCC lacked legal authority, asserting that the EFCC Act required ratification by all state Houses of Assembly to be valid under Section 12 of the 1999 Constitution.

In response, Kemi Pinheiro, SAN, representing the EFCC, urged the court to maintain the validity of the arrest warrant until Bello’s appearance for trial.

Pinheiro contended that Bello’s absence and subsequent legal maneuvers were delaying tactics intended to impede the judicial process.

The EFCC underscored that Bello’s case involved allegations of embezzlement and illicit property acquisition, both domestically and internationally.

The anti-graft agency offered to withdraw the arrest warrant if Bello’s counsel ensured his presence at the next court hearing.

Furthermore, EFCC clarified that the charges were related to the misuse of public funds and unlawful property acquisitions.

The legal battle between Yahaya Bello and the EFCC continues to unfold, highlighting complex legal arguments and procedural challenges.
