In a significant development, the Federal High Court in Abuja has dismissed the money laundering charges brought against former Attorney-General of the Federation (AGF), Mohammed Adoke. Justice Inyang Ekwo, delivering the ruling on Friday, upheld a no-case submission filed by Adoke, citing the failure of the Economic and Financial Crimes Commission (EFCC) to establish a prima facie case against him.
The charges, dating back to 2017, alleged money laundering involving Adoke and property developer Abubakar Aliyu to the tune of N300 million. Although the case did not explicitly mention the OPL 245 transaction, similar particulars were presented by the EFCC in a separate case before Justice Abubakar Kutigi of the FCT high court in 2020.
The EFCC, while acknowledging a mortgage taken by Adoke from Unity Bank, had initially alleged before Justice Kutigi that the funds were a bribe from the sale of the oil block by Malabu Oil & Gas Ltd in 2011. However, Justice Kutigi dismissed the charges against Adoke and other defendants on March 28, 2024, highlighting contradictions and criticizing the EFCC for a prolonged legal process.
In his ruling, Justice Ekwo echoed similar sentiments, emphasizing the lack of evidence to substantiate the allegations against Adoke. Consequently, he granted a no-case submission, leading to the discharge and acquittal of Adoke.
However, the ruling stipulated that the second defendant, Aliyu, must proceed to open his defense as there are unresolved matters against him.
