Legal Restriction On Pro-Wike Speaker: APC Pushes For Sanctions Against Judge (Details)

The court granted an Interim Order, restraining Amaewhule from accessing the assembly premises, following the governor’s directive that the facility was under renovation. The order warned of a N50,000,000.00 penalty if the application was found frivolous. The court further mandated the claimants to serve the Interim Order and related documents to the defendants by December 13, 2023. The court also issued interim injunctions to prevent the defendants from using armed personnel to access the assembly complex and disrupting legislative operations until the burnt building’s renovation is complete.
However, the All Progressives Congress (APC) Caretaker Chairman in Rivers State, Chief Tony Okocha, rejected the court’s judgment, labeling it as procured. Okocha announced the party’s intention to petition the National Judicial Commission (NJC) against Justice M.W. Danagogo, accusing him of violating NJC orders. The APC argued that the order was orchestrated to allow the governor to present the 2023 budget to the assembly. The party vowed not to comply with the order, declaring it as procured and illegitimate.
In response, the APC stated that it would petition Justice Danagogo to the NJC if the judge did not reverse the decision promptly. The party emphasized that it would not tolerate intimidation, harassment, or threats against its members and reaffirmed its refusal to acknowledge the court’s order. The APC alleged that the judgment was politically motivated and accused Justice Danagogo of disregarding established legal principles.
Meanwhile, the National Working Committee (NWC) of the Peoples Democratic Party (PDP) has scheduled an emergency meeting to address the defection of 27 members in the Rivers State House of Assembly to the APC. PDP National Publicity Secretary, Debo Ologunagba, reiterated that the seats belonged to the PDP, and the NWC would take immediate action to reclaim its mandate.
The PDP plans to write to the Independent National Electoral Commission (INEC) to demand fresh elections to fill the vacant seats. In response, INEC stated that it would act upon receiving an official communication from the Speaker of the State Assembly declaring the vacancies.
This legal and political dispute in Rivers State reflects the ongoing tensions between political factions, with both sides asserting their claims and intentions through legal channels and public statements.
