Nigerians Panic As Niger High Court Upholds Removal Of Village Head For Severe Insubordination....KINDLY READ THE FULL STORY HERE▶

Justice Maimuna Abubakar of the Minna High Court has upheld the removal and dismissal of Amana Kakanda, the village head of Muye in Niger State, Abdulqadir Muhammad Maigari, due to gross insubordination in the state.

Mairiga was removed from his position during the previous administration of Governor Abubakar Bello in 2021, following allegations of gross insubordination, particularly for blowing royal trumpets during official outings.

In response, the village head, along with some title holders from Muye, filed a lawsuit at the high court, represented by their Counsel, N. A Tanko and A. N Musu, challenging his removal. They sought the court’s declaration that his dismissal was illegal, null, and void.

The complainants presented eight requests to the court, including the reinstallation of the embattled village head and the payment of his withheld salary arrears. They also sought a declaration that the traditional ruler, as the Amana of Kakanda/village head of Muye, could not be punished or sanctioned for actions not provided for in the law. They argued that he was not afforded a fair hearing before his dismissal.

On October 31, 2023, the presiding judge, Justice Abubakar, dismissed seven out of the eight reliefs requested by the plaintiffs. She, however, granted relief no.3, which pertained to the payment of the embattled royal father’s withheld salary arrears during the period of his suspension before his final dismissal. Reliefs 1, 2, 4, 5, 6, 7, and 8 were denied.

Justice Abubakar explained that the complainants had failed to substantiate their case for the reliefs sought, except for relief No. 3, which concerned the payment of salary arrears. She also clarified that the claim that the 1st plaintiff had not received a fair hearing from the investigative committee was untrue, as he had been queried on two separate occasions, answered the queries, and presented documents in his defense to the committee.

Furthermore, the court directed the 2nd defendant to pay the 1st plaintiff all his salary arrears as the village head of Muye from the time of his appointment on grade level 07/06, starting from April 15, 2020, until his removal/dismissal on May 20, 2021.

The case named several defendants, including the Governor of Niger State, Lapai Local Government Council, Etsu Lapai Alh. Umaru Bago III, and two others.
