Just In: Ogun Community Residents Sue Customs Over Petroleum Product Restrictions....KINDLY READ THE FULL STORY HERE▶

A lawsuit has been filed by the All Youths Re-Oriented Initiative (AYRIN) against the Nigeria Customs Service Board and the Comptroller-General of the Nigeria Customs Service. This legal action is in response to a directive issued against the movement of fuel and petroleum products in communities near the country’s borders.

The suit, numbered FHC/AB/CS/87/23 and filed at the Federal High Court in Abeokuta, Ogun State, questions the legality of preventing Nigerians living in communities located a certain distance from the nation’s borders from buying, selling, or accessing petroleum products.

The plaintiffs, who are representing themselves and other Nigerians residing in border communities nationwide, are seeking the court’s decision on the following key issues:

1. Whether the directive issued by the 1st and 2nd defendants to prohibit petrol tankers from dispensing fuel in Nigerian communities within twenty (20) kilometers from the Nigerian border is discriminatory, illegal, unconstitutional, and in violation of sections 42 and 43 of the 1999 Nigerian Constitution (as amended).

2. Whether the restriction of fuel from entering areas within 20 kilometers of the border has caused undue economic, social, and psychological hardships for Nigerians residing in these border areas.

The plaintiffs also request that the court declare the circular No.027 issued by the 1st and 2nd defendants on September 6, 2019, which prevents petrol tankers from transporting and selling fuel within twenty kilometers from Nigeria’s borders with other countries, as illegal, unconstitutional, null, and void.

The group argues that such a circular is inconsistent with the 1999 Nigerian Constitution (as Amended), and that the defendants lack legal justification to issue such a directive.

The affidavit in support of the suit was deposed to by Oguntoyinbo Olufemi Ajadi, the President of the group. Ajadi confirmed that he had the consent of all group members to submit the affidavit to the court. He added that the group’s membership extends across affected areas in Ogun State and beyond, including locations such as llaro, Afon, Owode-idiroko, Ajegunle Ajilete, Wasimi-Okuta, Iwoye, Okeagbede, Idofa, and Imeko.
