DAY-OF-RECKONING ARRIVES: Court Orders Day-To-Day Trial As El-Rufai’s Removal Bid Fails!.

Delivering the ruling, Justice Khobo held that while the defendant’s right to raise concerns over alleged bias was not waived by prior conduct, the application itself lacked merit as no actual likelihood of bias was established. However, the court ruled against the applicant on the grounds of procedural misconduct, noting that filing concurrent legal processes at both the Court of Appeal and the State High Court constituted a clear abuse of the judicial process.
With the application dismissed, Justice Khobo ordered that the substantive trial proceed on a day-to-day basis where practicable. The court also ordered that the defendant remain in the custody of the Independent Corrupt Practices and Other Related Offences Commission (ICPC) pending the continuation of proceedings, with the case subsequently adjourned to October 12 and 13, 2026, for accelerated hearings.
