Jonathan Wants Special Constitutional Court To Settle Election Disputes.
Former President Goodluck Jonathan has called on the National Assembly to reform Nigeria’s electoral litigation system by creating a specialised Constitutional Court to handle election-related disputes.....KINDLY READ THE FULL STORY HERE▶
Jonathan made the appeal on Wednesday in Abuja during the 70th birthday celebration and book launch of Senator Gbenga Daniel (APC, Ogun East). He argued that establishing a dedicated court for election cases would reduce pressure on Nigeria’s political and judicial systems and streamline dispute resolution.
Criticising the current three-tier system—which sees governorship election cases move from the election tribunal to the Court of Appeal and finally the Supreme Court—Jonathan described it as inefficient. He suggested a single specialised court could resolve election disputes more swiftly.
He said, “If the Supreme Court continues to be the terminal court for governorship elections, there’s no need for the lower tribunals. The ideal approach, which I considered while in office, was to have one tribunal handle all political litigation.”
Jonathan recalled a controversial 2011 gubernatorial election case in which votes were annulled because red ink was not provided in a senatorial district, even though voters had marked their choices using black or green pens. The Appeal Court upheld the cancellations despite the lower tribunal’s ruling that “a tick is a tick.”
While the law was later amended to allow direct appeals to the Supreme Court, Jonathan argued that the reform did not address the lengthy litigation process. He encouraged Nigeria to adopt the model used in many Francophone African countries, where constitutional courts exclusively handle election disputes.
“This is how it works in Francophone Africa—constitutional courts decide all election matters,” he said. He also urged the judiciary to act decisively in political cases to ensure fairness, likening politics to soccer and judges to referees: “If the referee looks the other way, players will break legs or score with their hands.”
Jonathan also praised Senator Gbenga Daniel as a constructive leader with an engineering mindset, noting his role as South-West Zonal Coordinator during Jonathan’s 2015 campaign. He commended Daniel for documenting his life experiences in books, stressing that personal accounts correct public misconceptions.
The event was attended by notable figures, including President Bola Tinubu (represented by Minister of Finance Wale Edun), former President Olusegun Obasanjo, traditional rulers, and other political leaders.
