BREAKING: Court Discharges, Acquits Suspended DCP Abba Kyari.
Justice James Omotosho of the Federal High Court in Abuja has cleared and acquitted suspended Deputy Commissioner of Police, Abba Kyari, of a 23-count charge of alleged non-declaration of assets brought against him by the National Drug Law Enforcement Agency (NDLEA).....KINDLY READ THE FULL STORY HERE▶
Kyari was tried alongside his two brothers, who were accused of swearing false affidavits to allegedly conceal the source of certain properties said to be linked to the embattled officer.
In his judgment, Justice Omotosho ruled that the prosecution failed to present sufficient and credible evidence to substantiate the allegations against the defendants. He held that the NDLEA did not prove that the properties in question were actually owned by Kyari.
The judge explained that ownership of landed property can be established through traditional history, valid title documents, acts of possession, or possession connected to ownership. However, he noted that none of these were convincingly demonstrated in court.
The court specifically found that the prosecution failed to establish that a property at Fountain Estate, Kasana, legally belonging to Ramatu Kyari, was owned by Abba Kyari. It also held that no concrete evidence linked him to other properties located on Linda Choko Road, Asokoro, Abuja, and in Maiduguri, Borno State.
During the proceedings, Kyari had maintained that the Maiduguri property belonged to his late father and was inherited by him and his siblings. The court ruled that the prosecution did not disprove this claim.
Justice Omotosho further held that the alleged conspiracy involving Kyari’s brothers was not established, noting that the prosecution failed to prove they knowingly swore false affidavits to conceal the origin of the assets.
Describing the case as weak and unsupported by credible proof, the court consequently discharged and acquitted Kyari and his brothers on all counts.
The judge also remarked that having served the country, the defendant should not face persecution in the absence of solid evidence.
