Court Clears ICPC To Prosecute Two Former Lawmakers.

The Court dismissed suits filed by former Abia State House of Assembly members, Kalu Chikwendu and Apugo Chukwudi J., who sought to prevent the Commission from summoning them over a petition concerning their conduct while in office.
The cases, FHC/UM/CS/108/2025 and FHC/UM/CS/109/2025, argued that Section 28 of the Corrupt Practices and Other Related Offences Act, 2000—which underpinned the Commission’s invitations—was inconsistent with Sections 35 and 36 of the 1999 Constitution (as amended).
In its ruling, the Court affirmed that the ICPC has the statutory authority to investigate corruption and related offences, and that Section 28 of the Act does not conflict with the cited constitutional provisions.
The Court further noted that the plaintiffs’ lawsuits were an attempt to misuse the judicial process to avoid lawful investigation. Consequently, all reliefs sought by the former lawmakers were denied, with the Court stating that granting them would effectively shield them from the ICPC’s legal powers.
Additionally, the Court found the suits were filed in bad faith (mala fide) and ordered each plaintiff to pay ₦500,000 in costs.
This judgment clears the way for the ICPC to continue its investigation into the former lawmakers.
