UBA Ordered To Release ₦1.07 Billion To Former Deputy Governor After Court Ruling.
The National Industrial Court in Abuja has directed United Bank for Africa (UBA) Plc to pay ₦1.07 billion to former Kogi State Deputy Governor, Simon Achuba, to satisfy a longstanding judgment debt owed by the Kogi State Government.....KINDLY READ THE FULL STORY HERE▶
Justice R. B. Haastrup delivered the ruling on November 27, making absolute a previous garnishee order after dismissing UBA’s objections regarding the nature of funds in the account targeted for enforcement. UBA had argued that the funds in the Kogi State ACRESAL IDA Designated Account, a dollar-denominated account, were World Bank-supported and intended for environmental projects in 19 northern states, claiming they could not be accessed.
The court, however, found that UBA failed to provide credible evidence to support its claim. Justice Haastrup emphasized that once a garnishee admits holding funds sufficient to satisfy a judgment debt, it must prove any alleged restriction. “The law does not permit depriving a successful litigant of the fruits of his judgment,” the judge stated.
Represented by human rights lawyer Femi Falana (SAN), Achuba had petitioned the court to make the order absolute, citing UBA’s admission that it held sufficient funds in the account.
The court ordered UBA to pay:

₦1,070,860,138 – outstanding judgment debt
-
₦2,000,000 – costs awarded by the Court of Appeal

₦1,000,000 – cost of the garnishee proceedings
All payments are to be made directly into Achuba’s Access Bank account. Other banks previously joined as garnishees, including Zenith Bank, First Bank, GTBank, Access Bank, and Polaris Bank, were discharged.
Justice Haastrup also criticized the conduct of Kogi State Government’s counsel, Paul Daudu (SAN), describing his application as malicious and aimed at undermining appellate court orders. The court imposed a personal fine of ₦1 million on Daudu in favor of Achuba.
The ruling marks a major development in Achuba’s prolonged legal battle with the Kogi State Government over his controversial removal from office in 2019.
