Nnamdi Kanu Lists Malami, Wike, Sanwo-Olu, Others as Witnesses in Terrorism Trial

Kanu, through his legal team, filed a motion dated October 20 and submitted to the court on October 21. In the motion, he listed 23 witnesses, among them former Attorney-General of the Federation Abubakar Malami, Minister of the Federal Capital Territory Nyesom Wike, Minister of Works Dave Umahi, Lagos State Governor Babajide Sanwo-Olu, former Chief of Army Staff Tukur Buratai, and retired General Theophilus Danjuma.
The filing, marked FHC/ABJ/CR/383/2015, was titled “Notice of Number and Names of Witnesses to be Called by the Defendant and Request for Witness Summons/Subpoena and Variation of Time Within Which to Defend the Counts/Charges Against the Defendant.”
Kanu told the court he was ready to open his defense on October 24, as directed in the court’s earlier order of October 16. He asked the court for a 90-day period to present his defense, citing the number and seniority of the witnesses he intends to call.
The IPOB leader divided his witnesses into two groups: “ordinary but material witnesses” and “vital and compellable witnesses.” Those he described as compellable are expected to be subpoenaed under Section 232 of the Evidence Act, 2011.
Among other names on the list are former Abia State Governor Okezie Ikpeazu, former Director-General of the State Security Service Yusuf Bichi, and former National Intelligence Agency boss Ahmed Rufai Abubakar.
Kanu also stated that he would testify in his own defense, saying he would “provide a sworn account of the facts, denying the allegations and explaining the political context” of his statements and actions.
His request comes just days after his legal team filed a preliminary objection challenging the court’s jurisdiction to continue the case. The objection followed a medical report declaring Kanu fit to stand trial.
Kanu, who has been in the custody of the Department of State Services (DSS) since his arrest in Kenya and subsequent return to Nigeria in 2021, faces charges of terrorism, treasonable felony, and incitement. He has consistently denied the charges, describing them as politically motivated.
In a related development, a magistrate court in Abuja has ordered the remand of Kanu’s special counsel, Aloy Ejimakor, and 12 others who were arrested during a protest led by activist Omoyele Sowore on October 21. The group was charged with conspiracy, inciting disturbance, and public order violations.
Legal analysts say Kanu’s decision to summon top government officials and retired generals marks a bold turn in his defense strategy. “It could significantly prolong the trial, but it may also shift the narrative toward issues of governance and human rights,” one Abuja-based lawyer told reporters.
The Federal High Court is expected to hear Kanu’s motion for the 90-day defense period at the next sitting. If approved, the move could extend the proceedings well into 2026, potentially setting the stage for one of the most politically charged trials in Nigeria’s recent history.
The case continues to draw national and international attention, as observers watch how the court handles Kanu’s request and whether the prominent witnesses he listed will be compelled to appear.
