Senior Advocate Adeboro Adams Affirms Nigerians’ Right to Peaceful Protest Within Legal Boundaries

In a recent interview on ARISE News, Adams emphasized that Sections 39 and 40 of the 1999 Constitution guarantee citizens the freedoms of expression and assembly, which encompass the right to protest. However, he clarified that these rights are not absolute and must be exercised within lawful limits.
“The right to protest is constitutionally protected, but it must be conducted peacefully and in accordance with the law,” Adams stated. “This position has been validated by our courts.”
Adams also addressed the role of law enforcement in regulating protests. He noted that the police have the authority to enforce court orders and regulate protest locations to maintain public order. “The Public Order Act gives government and law enforcement the authority to regulate the location and manner of protests,” he explained. “If a court directs protesters to avoid certain places, that in itself is lawful.”
However, Adams cautioned that the right to regulate protests does not extend to the use of violence or excessive force against peaceful demonstrators. “If the police attack protesters outside the restricted areas, then they have violated the law,” he asserted. “When there is wrong, there must be a remedy. Protesters who are unlawfully attacked have every right to seek redress in court.”
He further explained that a protest ceases to be peaceful when it disrupts public order or infringes on the rights of others. “Your right to protest is not absolute,” Adams noted. “Where your right hampers the rights of others, law enforcement can intervene.”
Adams also questioned the timing of recent protests demanding the release of IPOB leader Nnamdi Kanu, stating that there was no justification for street action while the matter remains before the court. “The matter is still in court,” he said. “The prosecution has closed its case, and the defence has filed a no-case submission, which was dismissed. The case has been adjourned for the defence to open. Why are we in a hurry? Allow the court to conclude the process.”
He urged Nigerians to exhaust all legal avenues before resorting to street protests. “Justice is not about speed alone — sometimes patience is part of justice,” Adams concluded.
Adams’ comments come amid ongoing debates about the balance between citizens’ rights to protest and the need for public order. While the Nigerian Constitution protects the right to peaceful assembly, the Public Order Act and other regulations grant authorities the power to impose restrictions to maintain public safety and order. Legal experts continue to examine the interplay between these laws and the constitutional rights of citizens.
