Supreme Court Reserves Judgment in Osun Allocation Case Against AGF
ABUJA — Nigeria’s Supreme Court on Tuesday reserved judgment in a suit challenging the allocation of funds to Osun State, a case brought against the Attorney General of the Federation (AGF).....KINDLY READ THE FULL STORY HERE▶
The case, filed by civil society groups and political stakeholders, questioned the legality and fairness of the financial allocation to Osun State under the national revenue-sharing formula. Plaintiffs argued that the state’s allocation did not reflect the provisions of the Constitution and relevant fiscal laws.
During proceedings, the counsel for the plaintiffs urged the court to declare the allocation unlawful and to compel the federal government to provide a review mechanism. The legal team argued that the allocation undermined equitable distribution among states, affecting development and social services.
Representing the AGF, the government’s lawyers maintained that allocations are determined strictly according to established guidelines and statutory instruments. They insisted that the process is transparent and that Osun State received its share in line with constitutional and legal provisions.
The Chief Justice of Nigeria (CJN), who presided over the case, listened carefully to arguments from both sides before adjourning for judgment. The CJN did not indicate when the ruling would be delivered but noted the court will take time to review all submissions and evidence thoroughly.
Legal experts say the case is significant because it could set a precedent on how allocations to states are interpreted under the law. “This matter touches on the fiscal autonomy of states and the accountability of the federal government in revenue distribution,” said a constitutional law scholar who asked not to be named.
The plaintiffs’ contention focuses on what they call “systemic inequities” in federal allocations. They argue that certain states, including Osun, have historically received allocations that do not reflect population, developmental needs, or statutory guidelines, creating disparities that hinder progress.
Meanwhile, the AGF’s defense highlights the federal government’s efforts to maintain fairness and transparency in revenue-sharing. “All allocations are determined using approved formulas, and Osun’s allocation was consistent with these standards,” said a senior government lawyer in court.
Civil society observers and media analysts are closely following the case, saying it may have broader implications for Nigeria’s federal system. If the court rules in favor of the plaintiffs, it could lead to calls for a review of allocations nationwide, potentially reshaping financial planning and resource distribution among states.
In recent years, disputes over federal allocations have sparked tensions between states and the federal government. While Nigeria’s constitution mandates equitable sharing of resources, interpretation of the formula has often led to disagreements, sometimes escalating into high-profile court battles.
For Osun State, the outcome is particularly important. Stakeholders argue that fair allocations are essential for funding education, health, infrastructure, and other critical services. A favorable ruling could improve the state’s financial planning and development initiatives.
The Supreme Court’s reserved judgment underscores the judiciary’s role as the final arbiter in disputes over federal powers and state rights. Until the ruling is delivered, both the plaintiffs and the AGF must wait, leaving policymakers and citizens eager to see how the court interprets the law regarding state allocations.
The case marks yet another chapter in Nigeria’s ongoing debate over fiscal federalism and equitable resource distribution, highlighting the balance between constitutional mandates and practical governance.
