Explosive Claim: Police Pension Scheme Breaches Constitution — IHRC Warns FG”

This stance was made public in a diplomatic memo addressed to President Bola Tinubu, titled “A Diplomatic Appeal for Police Pension Welfare Reform in Line with the Constitution of the Federal Republic of Nigeria.”
In a statement signed on Saturday by Fidelis Onakpoma, IHRC’s Head of Media and Strategic Communications, the Commission described the current pension arrangement for police retirees as a clear constitutional violation and urged the President to initiate urgent reforms.
IHRC Head of Mission, Ambassador Duru Hezekiah, was quoted as saying:
“The Commission fully backs the Inspector-General of Police’s campaign for a fair and equitable pension system for retired police officers.
We call on President Tinubu to swiftly address the structural defects in the CPS, which breach constitutional provisions on the dignity and welfare of public officers.”
Citing Sections 17(3)(f) and 34(1)(a) of the 1999 Constitution (as amended), IHRC argued that the Nigerian state is legally obligated to protect the welfare and dignity of its retired officers—a duty it is currently neglecting.
According to the Commission, thousands of retired police officers are languishing in hardship under a pension system that ignores the unique sacrifices of law enforcement personnel.
“The current structure of the CPS, as applied to police officers, is grossly inadequate, unjust, and inconsistent with Nigeria’s constitutional ideals. These officers risked their lives in service, only to retire into poverty and neglect,” the statement noted.
The IHRC’s intervention follows a high-level meeting convened by the IGP on July 1, 2025, at Force Headquarters, Abuja.
Present at the meeting were leaders of the National Association of Retired Police Officers of Nigeria, led by AIG Paul O. Ochonu (retd.), and the Coalition of CPS Retirees, led by CP Henry Njoku (retd.), where they jointly expressed concern over the inadequacies of the current pension scheme.
At the session, IGP Egbetokun reaffirmed his commitment to securing a more just and practical pension structure, describing the current CPS as a profound injustice.
“Our retirees deserve dignity and meaningful support—systems that reflect the level of sacrifice and risk they took in service to this nation,” Egbetokun declared.
His remarks echoed previous criticisms made in February, during an interactive forum with retired officers in Abuja, where he described the CPS as “deeply flawed and misaligned with the demands of policing.”
The IHRC further condemned what it called an “unjust disparity” between the pension treatment of military and police retirees.
While military personnel have been exempted from the CPS and enjoy a more fitting retirement plan, police officers continue to be subjected to a scheme that offers little security in old age.
“The military’s exemption from the CPS rightly acknowledges the nature of their work. The same argument—perhaps even more compelling—applies to police officers who daily put their lives on the line,” said Hezekiah.
“Denying them a dignified retirement is a violation of justice, fairness, and national interest.”
Aligning with the goals of President Tinubu’s Renewed Hope Agenda, the IHRC urged the Federal Government to correct this long-standing injustice and live up to its constitutional and moral obligations to its security personnel.
“Fixing the police pension system isn’t just policy—it’s a matter of constitutional duty and national conscience.
This administration has a historic opportunity to correct this injustice and restore dignity to our police retirees,” the IHRC concluded.

Banking Procedures: Despite the large sums, Agulu maintained that he followed standard banking procedures, noting that some clients were granted verbal waivers by senior officials to deposit large amounts of cash.

Refusal to Name Officials: When asked to identify the senior bank officials who provided these verbal waivers, Agulu declined to provide names to avoid getting anyone in trouble.

Additional Transactions: Agulu also testified that he supervised a transfer of ₦1.6 billion to MG Properties Limited.
The Economic and Financial Crimes Commission (EFCC) is prosecuting Emefiele on eight counts, including criminal breach of trust, conspiracy, forgery, and unlawful possession of properties allegedly linked to proceeds of crime; Emefiele has entered a plea of not guilty. Eric Ocheme, who was named in the charges, is reported to be at large. Justice Yusuf Halilu has adjourned the trial for continuation on November 3, 4, and 5, 2026.
