The judge had originally fixed June 19 for judgment after the applicant’s counsel adopted his final written address. However, the court did not sit on the scheduled day due to other official engagements. The new date was subsequently communicated to all parties involved.

The case, which centres on alleged threat to life, assault, battery, and maltreatment, was instituted against the Nigerian Army and seven others, including the Chief of Army Staff, the General Officer Commanding 81 Division, the Commandant of Command Day Secondary School Lagos, and four soldiers—Lieutenant Akabor, and Privates Sani, Ahmed, and Montero—who are listed as the 1st to 8th respondents.

On March 1, 2025, the court had ordered that the respondents be served via substituted means by publishing the court processes in a widely circulated newspaper within the Federal Capital Territory. This followed an ex parte application argued on behalf of the plaintiff.

Despite being served, none of the respondents appeared in court or sent legal representation during the proceedings. The applicant tendered several exhibits, including a Certificate of Compliance and video evidence of the alleged assault.

In a bench ruling, Justice Abdulmalik scheduled judgment for June 19 and directed that hearing notices be served on all respondents. That date was later shifted to July 3 due to the court’s absence.

In the suit, filed in November 2024, Akhigbe alleged that on June 10, 2024, he was brutally attacked by the 5th to 8th respondents after being accused of filming inhumane punishments being meted out to SSS3 female students who were ordered to roll in muddy water.

According to him, while leading the group to the administrative block for resolution, the soldiers, allegedly acting on the instructions of Lieutenant Akabor, descended on him, beating him with planks, sticks, koboko, and metal rods. Court Orders Investigation Into Registrar, Defendant Over ₦10B Fraud Evidence Tampering.

The attack reportedly caused profuse bleeding from his head, forcing academic activities to halt as civilian staff protested in solidarity. The Commandant allegedly placed the assailants in military police custody and covered his medical expenses amounting to N180,000.

Akhigbe also recounted that his condition worsened weeks later, leading to hospitalisation in Abuja. He said his union, the Association of Senior Civil Servants of Nigeria, issued a demand letter seeking compensation on his behalf. Despite further legal notification to the respondents, no response was received.

The plaintiff is now seeking several reliefs from the court:

  • A declaration that the actions of the 5th to 8th respondents amounted to a gross violation of his constitutional rights to dignity, life, and freedom from inhuman treatment under Section 34(1) of the Nigerian Constitution and Articles 4 and 5 of the African Charter on Human and Peoples’ Rights.

  • An order restraining the respondents and their agents from further violating his rights.

  • A directive mandating the 5th to 8th respondents to issue a public video apology aired on two national TV stations.

  • N500 million as general damages for rights violation and an additional N50 million as the cost of litigation.
