The Federal Government, under President Bola Ahmed Tinubu, has granted approval for the prosecution of former Senator representing Anambra South, Andy Uba, in connection with an alleged ₦400 million fraud.

The approval was granted on Monday by the Attorney-General of the Federation (AGF) and Minister of Justice, Lateef Fagbemi (SAN).

This development was disclosed during a court session at the Federal High Court in Abuja, where counsel to the Inspector General of Police (IGP), A.M. Abdullahi, informed Justice Mohammed Umar that the AGF had reviewed the case and directed the police to proceed with prosecution.

Initially, a two-count charge was filed against Uba, Crystal Uba, and Benjamin Etu on October 10, 2024. However, in an amended charge submitted on March 4, 2025, Crystal Uba’s name was dropped, leaving only Uba and Etu as defendants.

According to the charge, Uba, Etu, and one Hajiya Fatima (currently at large), allegedly conspired in 2022 to defraud a businessman, George Uboh, of ₦400 million by falsely claiming they could secure him the position of Managing Director of the Niger Delta Development Commission (NDDC).

“A representation which you knew to be false, thereby committing an offence contrary to Section 8 and punishable under Section 1(3) of the Advance Fee Fraud and Other Fraud Related Offences Act, 2006,” the charge reads.

In his petition dated April 5, 2023, Uboh submitted documentary evidence and audio recordings to support his claim. The prosecution plans to call six witnesses during the trial.

At an earlier hearing, the prosecution disclosed that the defendants had petitioned the AGF, prompting a case review. However, a letter dated May 8, 2025, from M.B. Abubakar, Director of Public Prosecutions (DPP), confirmed that a prima facie case existed against Uba, Etu, and Fatima. The DPP also stated there was no evidence linking Crystal Uba to the alleged offence.

When the case came up on Monday, only Etu and his lawyer, C.F. Odiniru, were present. Odiniru informed the court that Andy Uba was currently abroad receiving medical treatment.

He also claimed the financial dispute had been resolved.

“What is funny is that the subject matter of this charge has been settled. The money has been paid,” Odiniru told the court.

Justice Mohammed Umar adjourned the case until September 24, 2025, for further hearing.

The victims, which included candidates of the Joint Admissions and Matriculation Board (JAMB) heading to Otukpo for their examinations, have all been successfully rescued.

Speaking while briefing Governor Hyacinth Alia in Makurdi during the presentation of the freed victims, the Commissioner of Police, Ifeanyi Emenari, said the rescue operation was achieved through coordinated efforts of multiple security agencies.

He explained that five of the abducted passengers were first released, while the remaining 13 were rescued on Sunday morning without injuries.

He also noted that clearance operations have begun across forest areas in the state to flush out criminal groups, in line with directives from security authorities.

Governor Hyacinth Alia, while receiving the rescued passengers, expressed concern over rising cases of kidnapping in the state but welcomed the safe return of all 18 victims.

He confirmed that among those rescued were eight candidates on their way to write examinations, and called on the Joint Admissions and Matriculation Board (JAMB) to reschedule the affected exams for them.

He further directed the state health authorities to conduct medical evaluations for all rescued persons and promised government support for those affected.
