Lawyers Request ECOWAS Court Sanctions Against President Tinubu Over Rivers State Emergency Declaration
Nigerian legislative lawyers, represented by the Association of Legislative Drafting and Advocacy Practitioners (ALDRAP), have formally petitioned the Economic Community of West African States (ECOWAS) Court of Justice to impose sanctions on President Bola Tinubu. The lawyers are also seeking sanctions against the National Assembly leadership for their role in ratifying the emergency rule. In a broadcast on March 18, 2025, President Tinubu justified the move by citing concerns over political instability in the state, including allegations that Governor Sim Fubara demolished the State House of Assembly building. Following this declaration, Fubara, his deputy, and other members of the House of Assembly were suspended for six months, with Vice Admiral Ibas appointed as the Sole Administrator of the state.
Despite the passage of over a month since the declaration, Tinubu’s decision remains highly contested. Critics argue that it undermines democratic governance and violates both Nigerian and ECOWAS regulations. ALDRAP has demanded that Tinubu disclose the legal basis for appointing Ibas as Sole Administrator, threatening legal action if their request is ignored.
The suit, filed with the ECOWAS court, specifically challenges the legality of the suspension of democracy in Rivers State. It claims that the emergency rule contradicts ECOWAS principles on democratic governance, particularly the prohibition against unconstitutional changes of government. The lawyers are also calling for sanctions under ECOWAS’ legal framework for member states that breach democratic norms.
ALDRAP previously sent a letter to ECOWAS Heads of State urging them to sanction Tinubu, arguing that failing to act would reflect a double standard, especially after similar actions were taken against countries like Mali, Burkina Faso, and Niger. They contend that the imposition of military rule in Rivers State represents a dangerous precedent for democratic backsliding in the region.
In their communication, ALDRAP also refutes the justifications provided by Tinubu, stating that the crisis in Rivers was exaggerated and primarily driven by political rivalry between the current and former governors, both allies of the president.
