A significant legal development has occurred as Zhongshang Fucheng Industrial Investment Ltd, a Chinese company, successfully repossessed a private jet valued at $57 million from the Nigerian government. This jet, identified as a Bombardier 6000 type BD-700-1A10, was previously seized from Dan Etete, a former petroleum minister known for his controversial dealings, and had been stored in Canada.

Zhongshang’s repossession of the jet comes after it sought to confiscate Nigerian assets due to ongoing disputes. The necessary paperwork for the transfer of custodianship was provided by Canadian authorities in Montreal. Reports indicate that a Canadian court ruled in favor of Zhongshang, allowing the company to seize the aircraft from Nigeria.

According to sources familiar with the situation, “The court granted orders for Zhongshang to seize the plane earlier this year, but the change of custody from Nigeria to Zhongshang was only recently concluded.” The source emphasized that Zhongshang intends to continue pursuing Nigeria’s assets globally until all arbitration awards are paid.

On March 21, 2024, Judge David Collier of the Superior Court of Quebec dismissed Nigeria’s arguments to retain ownership of the aircraft. The jet was originally purchased for $57 million by Etete after he acquired a substantial profit from the sale of the OPL 245 oil field in 2010. Nigeria initially seized the aircraft in 2016, later relocating it to Dubai, and ultimately to Canada on May 29, 2020.

A Canadian company, Tibit, had previously attempted to claim ownership, but Nigerian authorities maintained control of the aircraft until now. In 2023, Zhongshang took legal action to seize the jet while enforcing its arbitration awards of over $70 million against Nigeria.

Judge Collier criticized Nigeria for not adequately responding to the aircraft’s seizure, deeming its claims of being unable to address the lawsuit due to the February-March 2023 general elections as frivolous. He also rejected Nigeria’s assertion of sovereign immunity, a claim that had already been addressed by the arbitration panel and courts in the United Kingdom.

With the Bombardier luxury aircraft now under Zhongshang’s control, the company has successfully executed asset seizures in the UK, France, and Canada, which include Nigeria’s guest houses and presidential jets. Expectations are high for further seizures in Belgium and the United States soon.

Despite facing setbacks in at least five countries, Nigeria continues to assert that it has done no wrong in the lawsuits stemming from a failed free trade zone contract in Ogun State. Efforts to resolve the situation between Nigeria and Zhongshang are ongoing, with no significant progress reported since their initial meeting in London in September 2023.

A spokesperson for President Bola Tinubu has yet to respond to inquiries regarding the latest developments surrounding this high-profile seizure.
