During a plenary session convened on Friday at the temporary chamber located in the Government House in Port Harcourt, Speaker Oko-Jumbo expressed his disagreement with the appellate court’s ruling.

“We firmly believe that the Court of Appeal erred in its judgment,” he stated, underscoring the assembly’s decision to escalate the matter to the Supreme Court of Nigeria.

Oko-Jumbo informed the assembly that their legal team had already lodged an appeal against the Court of Appeal’s decision. This marks the next phase in the ongoing legal battle concerning the legitimacy of the assembly members’ expulsion and the jurisdiction of the courts.

Amidst the legal and political turmoil, the assembly proceeded with legislative business during the session, deliberating on two significant bills.

The bills in question are the “Rivers State Emergency Management Agency Bill, 2024” and the “Rivers State Transport Reform Bill, 2024,” sponsored by Sokari Goodboy and Deputy Speaker Adolphus Timothy, respectively. These bills aim to address crucial aspects of state management and transport reforms.

The entire statement reads, “On December 11, 2023, Martin Amaewhule and his 24 associates defected from the Peoples Democratic Party to the All Progressive Congress. On December 13, 2023, Rt. Hon Edison Ehie, as the Speaker of the Rivers State House of Assembly, declared their seats vacant.

“To date, no court in Nigeria has overturned Rt. Hon Edison Ehie’s declaration.

“Despite their defection and the vacancy of their seats, Martin Amaewhule and the 24 others continued to claim membership in the RSHA. Legitimate members of the RSHA filed Suit No. PHC/1512/CS/2024 against Martin Amaewhule & 24 others in the Rivers State High Court, which issued orders restraining them.

“Dissatisfied with the rulings of the Rivers State High Court, Martin Amaewhule & 24 others appealed to the Court of Appeal, Port Harcourt Division, under Appeal No. CA/PH/198/2024.

“On July 4, 2024, the Court of Appeal allowed the appeal on the grounds that the Rivers State High Court lacked jurisdiction to hear Suit No. PHC/1512/CS/2024 and struck it out.

“The Court of Appeal did not declare that Martin Amaewhule & 24 others did not defect from the PDP to APC, nor did it declare them still members of the RSHA.

“We firmly believe that the Court of Appeal erred in holding that the Rivers State High Court lacked jurisdiction over Suit No. PHC/1512/CS/2024. Consequently, we have instructed our legal team to appeal the judgment to the Supreme Court of Nigeria.

“There cannot be two Houses of Assembly in Rivers State or any state in Nigeria. This House of Assembly, with me as Speaker, is the only legitimate House of Assembly in Rivers State.

“Despite their claims, Martin Amaewhule & 24 others are no longer members of the Rivers State House of Assembly until a court of competent jurisdiction determines otherwise.

“Once again, we, the legitimate members of the RSHA, call on the Independent National Electoral Commission to conduct a bye-election promptly to fill the vacant seats in the RSHA.

“We urge the general public to disregard Martin Amaewhule & 24 others and their claims of being members of the Rivers State House of Assembly.”

Rubio made these statements during a hearing before the House Foreign Affairs Committee regarding the State Department’s FY27 budget request, which was held on Wednesday in Washington, DC.

The U.S. official emphasized that the United States remains deeply concerned about the rising tide of violence in Nigeria, specifically highlighting attacks against Christians. He stated that this concern has translated into a new phase of active counterterrorism partnership with Nigerian authorities.

“We are now actively in counterterrorism cooperation with the Nigerian government and Nigerian security forces, including a joint operation a couple of weeks ago that took out the number two leader of global ISIS operating from inside of the country, and that continues,” Rubio informed the committee.

The operation, which was a coordinated U.S.-Nigerian assault on May 15, targeted the compound of Abu-Bilal Al-Minuki, identified as the second-in-command of global ISIS operations. The high-value target’s stronghold was located in the volatile Lake Chad Basin region.

Adding crucial context, U.S. Secretary of Defence Pete Hegseth further confirmed that Al-Minuki was the primary figure responsible for directing and executing multiple attacks on Christian communities across Nigeria.

President Bola Tinubu of Nigeria had previously confirmed the death of Al-Minuki, noting that several of his top lieutenants were also neutralized in the precise mission. Tinubu expressed his strong desire for continued, decisive military strikes against all terrorist enclaves within the country.

Since the successful elimination of Al-Minuki, subsequent reports indicate that more joint U.S.-Nigerian operations have targeted and destroyed terrorist positions. Just days after the initial operation, Nigeria’s Defence Headquarters announced that a series of joint airstrikes in Metele, Borno State, had killed more than 20 ISIS/ISWAP fighters. Furthermore, on June 1, a separate airstrike in Arege, Kukawa Local Government Area of Borno State, conducted by the Nigerian military in collaboration with the United States Africa Command, resulted in the death of an additional 21 ISWAP insurgents.
