ALDRAP argues that it is unconstitutional for these lawmakers to hold concurrent membership of the National Assembly, the ECOWAS Parliament, and the Pan-African Parliament while receiving emoluments from all three bodies.

Previously, ALDRAP called on the Senate President, Godswill Akpabio, to declare the seats of the affected lawmakers vacant due to their multiple parliamentary memberships. Now, the organization has taken legal action, serving a pre-action notice to the Senate President and the Clerk of the National Assembly.

In the notice, ALDRAP warned of a lawsuit if its request to declare the seats vacant was not heeded within seven working days. The organization maintains that such dual memberships violate constitutional provisions and international parliamentary laws.

The lawsuit filed at the Federal High Court, Abuja, seeks clarification on whether lawmakers must resign from the National Assembly before taking seats at the ECOWAS Parliament and the Pan-African Parliament. ALDRAP also questions the legality of ECOWAS Parliament legislation within Nigeria’s legislative framework.

In its prayers to the court, ALDRAP seeks declarations to halt the payment of salaries and benefits to the lawmakers in question and calls for bye-elections to fill the vacant seats at the National Assembly.

As the legal proceedings unfold, the outcome could have significant implications for Nigeria’s parliamentary landscape and the adherence to constitutional and international parliamentary norms.

Multiple factions are now locked in a struggle for control of the party, leaving members uncertain about the legitimate leadership structure.

One faction is led by John Akpanudodehe, a former National Secretary of the All Progressives Congress (APC), while another is headed by the embattled state chairman, Dick Duke.

Although the leader of a third faction could not be immediately confirmed, findings indicate that another group also exists within the party.

He said the party had formally written to the Independent National Electoral Commission (INEC) to distance itself from the exercise, citing a subsisting court order.
