Court Orders ₦5 Million Damages Against EFCC For Misidentification Of Photographer....KINDLY READ THE FULL STORY HERE▶

In a significant legal ruling, Justice D.U. Okorowo of the Federal High Court, Abuja, has ordered the Economic and Financial Crimes Commission (EFCC) to pay ₦5 million in damages to photographer Nasiru Saidu Ali, Kozzo, for wrongly parading him as a fraudster. The incident occurred in May 2019 when Ali was mistakenly apprehended from his residence in Abuja and his images were prominently featured on EFCC’s social media platforms alongside those of alleged internet scammers……..READ ALSO

Following his release and the establishment of his innocence, Ali pursued legal action against the EFCC for criminal defamation of character. Represented by his lawyer, Pelumi Olajengbesi, Ali initially sought ₦100 million in damages. However, after five years of legal proceedings, the court delivered a landmark judgment on Friday, March 22, 2024, awarding ₦5 million in damages against the EFCC and mandating the agency to issue a public apology to the photographer.

Olajengbesi emphasized the unlawfulness and abuse of power inherent in the EFCC’s practice of publicizing images of individuals accused of crimes before obtaining court convictions. He noted that his law firm, Law Corridor, took up Ali’s case pro bono and successfully argued before the Federal High Court, Abuja, to uphold Ali’s rights to human dignity, privacy, and presumption of innocence.

The judgment, which deemed EFCC’s actions unconstitutional, serves as a precedent against similar violations of individual rights. Despite the initial demand for ₦100 million in damages, the court’s decision of ₦5 million, coupled with a perpetuated order preventing the EFCC from re-arresting the photographer, marks a significant victory for justice and protection of civil liberties.
