Supreme Court Holds Judgment In PDP’s Appeal Over Ogun Governorship Election

Governor Abiodun contested the recent election under the All Progressives Congress (APC) banner, while Adebutu ran on the Peoples Democratic Party (PDP) platform. Subsequent to the election results, Adebutu and the PDP appealed to the Supreme Court, seeking a directive for the Independent National Electoral Commission (INEC) to conduct fresh elections in the allegedly cancelled 99 polling units.
Lead counsel for the appellants, Chief Chris Uche SAN, argued that INEC did not deny the cancellation of elections in these 99 polling units. Uche asserted that Governor Abiodun and the APC were declared winners prematurely and unlawfully, as fresh elections were not conducted in these units.
Uche drew the attention of the Supreme Court to the election results, where Governor Abiodun and APC secured victory by a slim margin of 13,000 votes. He highlighted that the votes from the 99 polling units surpassed 40,000, a number capable of altering the election outcome.
Uche emphasized that the Ogun governorship poll could not be deemed conclusive without conducting elections in these 99 units. Therefore, he urged the Supreme Court to overturn the decisions of the Ogun State Governorship Election Petition Tribunal and the Court of Appeal, which validated the results of the gubernatorial election.
However, INEC’s counsel, Abiodun Owonikoko, SAN, advocated for the dismissal of the appeal. Lead counsel for the APC, Tayo Oyetibo SAN, also supported the dismissal, arguing that the election had concluded definitively. Oyetibo discredited the documents presented by the appellants, claiming election cancellations, as they lacked essential details and failed to meet the requirements of admissibility under the Electoral Act.
The second respondent aligned with the positions of INEC and APC. On November 24, 2023, the Appeal Court, Lagos Division, delivered a split decision affirming Dapo Abiodun’s reelection as the duly elected governor of Ogun State, dismissing the appeal filed by the PDP and its governorship candidate, Oladipupo Adebutu.
