Orubebe had been entangled in legal battles since 2015 when he was accused of failing to disclose ownership of certain properties on his asset declaration forms submitted to the Code of Conduct Bureau (CCB) during his tenure from 2007 to 2011.

The charges against Orubebe were rooted in Section 15 of the Code of Conduct Bureau and Tribunal Act Cap 15 Laws of the Federation of Nigeria, 2004, with potential penalties outlined in Section 23(2) of the same Act.

Maintaining his innocence, Orubebe pleaded not guilty to the allegations.

Orubebe’s defense centered on the argument that he had sold the disputed plot of land to his landlord before his last asset declaration upon leaving office, contending that it was no longer his asset to declare in 2011.

Initially ruling against him, the Code of Conduct Tribunal ordered the forfeiture of the property he failed to declare to the Federal Government.

Displeased with the Tribunal’s decision, Orubebe appealed to the Court of Appeal, which overturned the Tribunal’s ruling, absolving him of the conviction and the forfeiture order.

Subsequently, the Federal Government sought to challenge the appellate court’s decision by taking the matter to the Supreme Court.

In the lead judgment delivered by Justice Emmanuel Agim, the Supreme Court declared the Federal Government’s appeal incompetent, thereby upholding the Court of Appeal’s decision to acquit Orubebe.

This ruling brings an end to a protracted legal battle, affirming Orubebe’s stance and setting a significant precedent in cases involving asset declaration and public accountability.
