Through his legal representative, Nasir Adamu Aliyu, SAN, Inuwa expressed apprehension about the perceived lack of fair treatment during the trial, contending that he believes justice cannot be served in her courtroom.
Inuwa and his son, Bala Inuwa Muhammad, Jr., pleaded not guilty to the charges and have formally requested the case be reassigned to another judge within the Kano State High Court for a more impartial hearing.
Aliyu, the defendants’ counsel, outlined various grounds for the application, including the court’s dismissal of their preliminary objection challenging the court’s jurisdiction and the judge’s refusal to grant leave for appeal within the statutory 14-day period.
He further highlighted the judge’s decision to revoke the bail previously granted by another judge, Justice Naabba, leading to the defendants’ confinement in a correctional center for 30 days. Aliyu argued that these actions suggest potential bias, asserting that the presiding judge has shown a personal interest in the case. Consequently, he argued for the judge’s recusal to uphold the principles of justice in the proceedings.
