In a unanimous decision, the appellate court resolved all three issues presented against Uba and the PDP. Justice Onyekachi Aja Otisi, delivering the lead judgment, dismissed Uba’s allegations of non-qualification against Deputy Governor Samuel Ode. The court held that Uba failed to sufficiently prove the forgery of INEC Form EC9 by Ode, as required by law.

The Court of Appeal emphasized that the issue of non-qualification is a pre-election matter, properly challenged at a Federal High Court, not at the Governorship Election Petition Tribunal, as Uba had done. Additionally, the court stated that a suit contesting non-qualification must be initiated within 14 days of the occurrence.

Addressing Uba’s claim that the APC did not submit Governor Alia’s name to INEC within 180 days before the March 18 election, the court noted that the allegation was baseless. It clarified that the primary election producing Alia was court-ordered and conducted within the specified timeframe.

Ultimately, Justice Otisi concluded that Uba’s appeal lacked merit, upholding the judgment of the Benue State Election Petition Tribunal delivered on September 23. Consequently, the court affirmed Hyacinth Alia’s election as the Governor of Benue State.

He also approved an amendment extending the lifespan of the 2025 budget from March 31 to June 30, 2026, to ensure completion of ongoing capital projects nationwide.

Under the 2026 fiscal plan, ₦4.799 trillion is set aside for statutory transfers, ₦15.8 trillion for debt servicing, ₦15.4 trillion for recurrent spending, while ₦32.2 trillion goes to capital projects—about half of the total budget.

The focus, according to the administration, is on infrastructure development, security, and growth-driven investments aimed at improving living standards.
