Former President Muhammadu Buhari has emphasized that if Nigeria had lost its arbitration dispute with Process & Industrial Development (P&ID), it would have resulted in a potential loss of nearly $15 billion. In an article titled “A matter of principle,” released on Sunday, Buhari disclosed that during his tenure, he assigned his former chief-of-staff, Abba Kyari, and the Attorney General of the Federation, Abubakar Malami, to find a solution to the issue.

The recent development reported by The Nation states that the Business and Property Court in London had halted the enforcement of the $11 billion arbitration award favoring P&ID against Nigeria in a case identified as CL-2019-000752. Justice Robert Knowles, in his judgment, concluded that the process through which P&ID had secured a 2010 contract to construct a gas processing plant in Calabar, Cross River State, was tainted by fraud.

Responding to the situation, Buhari remarked, “Rarely in modern times can so few have tried to take so much from so many. If Nigeria had lost its arbitration dispute with Process & Industrial Development in a London court on 23 October, it would have cost our people close to USD15 billion. We won, and all decent people can sleep easier as a result. Justice Robin Knowles said Nigeria had been the victim of a monstrous fraud. But it was a close-run thing.”

Buhari emphasized that ordinary Nigerians did not make the decisions that led to the arbitration dispute. He described how P&ID, a relatively unknown company with few assets, had won a contract to build a gas processing plant in Cross Rivers but failed to commence construction. However, the contract stipulated that P&ID could sue Nigeria and claim all potential profits over 20 years as if the project had been completed.

He highlighted the efforts made to uncover evidence, including evidence of bribery and perjury on P&ID’s part, as well as the company’s possession of Nigeria’s internal legal documents. Buhari stressed the importance of following the legal process to resolve disputes, acknowledging that this case revealed the need for better contracts, greater transparency, and stricter sanctions for Nigerian public officials involved in fraudulent activities.

Buhari concluded by noting that while Nigeria had won this battle against corruption, the broader war against corruption was ongoing and called for a commitment to serve and protect the people of Nigeria.

Atiku said his advice was rejected at the time, despite his conviction that Nigeria’s political history had shown the importance of alliances.

The former vice president added that his support for coalition politics was also influenced by his desire to encourage the emergence of younger leaders he believes are vital to Nigeria’s future.

“I saw some of these younger politicians as the future leaders of this country, and I felt it was my duty to point that out,” he said.

However, Atiku claimed the resistance he encountered within the party was driven more by personal feelings than by disagreement over the substance of his proposal.

Atiku also expressed confidence in the political experience within the party, saying he believes a consensus is achievable and may make a full-scale primary contest unnecessary.

“That remains our preferred path. We will go for primaries if consensus fails, but I honestly do not expect it to get to that stage because we are dealing with mature and experienced politicians,” he added.

He made the remarks while stressing the need for experienced and capable leadership in Nigeria.
