The Nigeria Labour Congress (NLC) has issued a response to the Attorney General of the Federation (AGF) and Minister of Justice, Lateef Fagbemi (SAN), concerning the court order that restrains organized labor from proceeding with its planned strike.

In a statement on Friday, NLC President Joe Ajaero emphasized that a court restraining order should not be equated with a perpetual injunction, in response to the AGF’s call for organized labor to respect the June 5, 2023, order of the Industrial Court.
Ajaero expressed disappointment with the AGF’s stance, stating that instead of serving as a constitutional mediator between the federal government and labor unions, the AGF appeared to be biased and misinterpreting the law.
He questioned the basis of the AGF’s reference to a restraining order issued on June 5, which, according to the Ministry of Justice, had lapsed due to non-diligent prosecution. Ajaero also highlighted the distinction between a restraining order and a perpetual injunction, stressing the potential harm to the legal and judicial system.
Ajaero criticized the AGF for taking a partisan position, asserting that the Minister of Justice should maintain an impartial role, and he raised concerns about the violation of fundamental human rights if the labor unions were silenced without a chance to present their case.
He further pointed out the AGF’s counsel on protecting the integrity of courts and observing the sanctity of court orders, highlighting the discrepancy between this advice and the attempt to convert a restraining order into a perpetual injunction.
Ajaero concluded by reminding the AGF of the NLC’s long history of patriotic and popular struggles in Nigeria and asserted that the NLC does not need lectures on national interest, security, or sovereignty.
