The Cross River Governorship Election Petition Tribunal is set to announce its judgment on Tuesday regarding the petition filed by Prof. Sandy Onor of the Peoples Democratic Party (PDP) challenging the victory of Sen. Bassey Otu of the All Progressives Congress (APC). This announcement was made in a statement released by Mr. Akawu Bambu, the Secretary of the tribunal, on Sunday.
The lawsuit, registered as Suit No. EPT/CR/GOV/02/2023, was jointly filed by Onor and the PDP. During the proceedings, the legal representatives for Onor and Otu, Mr. J.Y. Musa, SAN, and Prof. Mike Ozekhone, SAN, respectively, presented their written arguments, which were endorsed by the three-member tribunal.

In his concluding written statement, Musa informed the court that the evidence uncovered during the respondents’ cross-examination supports the petition’s case and exposes the falsehood in the evidence presented by the second and third respondents, Governor Otu and Peter Odey.
Onor presented his case, including calling several witnesses, while Otu called upon 10 witnesses. Justice Oken Inneh, leading the tribunal, had reserved the judgment after both parties had presented their written arguments on August 13.
Musa clarified that the petitioners’ case does not revolve around allegations of forgery against any of the respondents (Otu and Odey). Therefore, the authorities cited by the respondents, suggesting the need to call witnesses from institutions, are irrelevant. Instead, their case centers on the assertion that the second and third respondents perjured themselves.
He emphasized that the second and third respondents (Otu and Odey) produced documents to substantiate their claim of document forgery. It should be noted that INEC had declared Otu as the election winner, with 258,619 votes, surpassing the PDP candidate, who secured 179,636 votes.
