In his decision on the lawsuit brought by Mohammed Modibbo against the Peoples Democratic Party and four other parties, Justice Abdulaaziz Anka declared the Peoples Democratic Party’s senatorial primary elections for Adamawa Central invalid.

The fourth defendant, Chairman of the Governing Council of Adamawa State University, Alhaji Auwal Tukur, participated as a political appointee in violation of the new Electoral Act 2022, the judge said, and as a result “the entire process is hereby annulled.”
He said, “The only issue proved before the court is as regards the fourth defendant’s engagement in the primary election conducted, him being a political appointee i.e chairman governing council Adamawa State University, Mubi, accordingly, the entire process is hereby nullified by this honourable court. The consequence, of which the party, will not be able to field a candidate for the general election come 2023 because of substantial non-compliance with the Electoral Act 2022. This is the consequential judgement of the court, against the entire political party and it’s members.”
The speaker of the Adamawa State House,Iya-Abbas, defeated Tukur, son of former chairman of the PDP, Babanga Tukur and five other aspirants that includes, Barrister D. D. Azura, Mohammed Modibbo,  Ibrahim Mustapha, Ibrahim Abubakar and Hon. Abdullahi Prambe, to clinch the senatorial ticket of the PDP, for Adamawa Central Senatorial District.
Dissatisfied with the primary’s result, Modibbo filed a lawsuit challenging the way it was conducted, namely whether Auwal Tukur, a political appointee who hadn’t quit his position, was allowed to vote.

Tukur’s involvement in the PDP’s senate primary, according to the court’s judgement, breached the Electoral Act 2022, hence the election was declared invalid.
