Supreme Court Shocks Ex-Kogi Deputy Gov, Cancels ₦1.07 Billion Judgment Award.

The Supreme Court has overturned a decision of the Court of Appeal which awarded former Kogi State Deputy Governor, Elder Simon Achuba, over ₦1.07 billion for alleged unpaid salaries, allowances, and other entitlements.....KINDLY READ THE FULL STORY HERE▶

The apex court ruled that the Court of Appeal went beyond its appellate powers by calculating and awarding specific monetary sums to Achuba through a post-judgment application.

It held that the proper procedure would have been to return the matter to the National Industrial Court, where it originated, for proper hearing and determination of the exact entitlements.

According to the Supreme Court, while an earlier judgment confirmed that Achuba was entitled to salaries and allowances, it did not specify the exact amount owed to him.

The court explained that any attempt to determine a precise monetary figure required fresh proceedings, supported by evidence, pleadings, and proper judicial assessment at the trial court level.

It further stated that a post-judgment motion cannot replace substantive legal proceedings in cases where financial claims must be properly calculated and proven.

The Supreme Court also noted that the Court of Appeal acted improperly by assuming the role of a trial court in computing and awarding the ₦1.07 billion claim, especially when no prior evidence-based determination had been made on the exact figures.

The appellants, led by Chief Joseph Bodunde Daudu, SAN, argued that the earlier ruling only established entitlement, not a specific sum, and that any monetary assessment should have been initiated at the National Industrial Court.

They also maintained that the Supreme Court had jurisdiction to hear the matter because the issue centred on whether the Court of Appeal wrongly assumed original jurisdiction.

The judgment was delivered by Justice Chioma Egondu Nwosu-Iheme and supported by three other Justices, while Justice Obande Festus Ogbuinya dissented.

In his dissenting opinion, he differed on whether the Court of Appeal merely enforced an existing judgment or improperly issued a fresh monetary award.

With the ruling, the Supreme Court ultimately set aside the ₦1.07 billion award previously granted in favour of Achuba.

The Minister of Education, Dr. Tunji Alausa, made this known on Monday during the 2026 policy meeting on admissions into tertiary institutions held in Abuja.

He explained that the policy was arrived at after extensive consultations with key stakeholders in the education sector, and is intended to strike a balance between inclusiveness and academic preparedness.

According to him, while the government acknowledges that some students are exceptionally gifted, such cases must be handled under strict and clearly defined guidelines to protect the integrity of the education system.

“Following extensive consultations and policy reviews, government has maintained sixteen years as the minimum age for admission into tertiary institutions,” he said.

“This position reflects a careful balance between inclusivity and academic readiness. While we recognise the existence of exceptionally gifted individuals, such cases must be treated within clearly defined and rigorously enforced guidelines to preserve the integrity of the system.”

Alausa also stressed that admissions outside the Central Admissions Processing System (CAPS) managed by the Joint Admissions and Matriculation Board (JAMB) would not be recognised.

He warned that any institution found violating the approved admission process would face sanctions, including possible withdrawal of its operating licence.

He described the admissions process as central to maintaining trust in the education system, adding that institutions must strictly comply with regulations.

“I have resisted many attempts at condoning illegality in the admissions process. I will not be a party to such actions,” he said.

“Any institution found to have conducted admissions outside CAPS will be held accountable, and appropriate sanctions shall be applied without hesitation.”

The minister further stated that the government would continue to enforce compliance to ensure order and credibility in the system, noting that the measures are corrective rather than punitive.

On digitisation, Alausa said Nigeria is moving towards full adoption of computer-based testing, describing it as a necessary step in line with global education standards.

He also noted that the government has intensified efforts to curb examination malpractice through improved verification systems and stronger monitoring mechanisms.

Sowore said he welcomed Yesufu’s move into elective politics, stressing that individuals who believe they can contribute to governance should actively participate rather than remain on the sidelines.

Naija News reports that Sowore made the remarks on Monday, May 11, during an interview on Channels Television’s The Morning Brief.

While backing her ambition, he, however, criticised her choice of political platform, noting that she joined the Nigerian Democratic Congress (NDC). Yesufu had reportedly left the African Democratic Congress (ADC), along with former Labour Party presidential candidate Peter Obi, before declaring her intention to run for the FCT Senate seat under the NDC.

Sowore said he would have preferred her to join his own political party.

“I truly support her. I’ve always told her that good people who believe they can do things should get into politics. She used to say she has no business running for office. She used to condemn those of us who are activists who run for office,” he said.

Politics As A Form Of Activism

Sowore noted that Yesufu’s decision reflects a shift from her earlier stance against activists participating in elections.

He added that he once held a similar belief before changing his mind, realizing that political engagement is essential for meaningful societal change.

“She doesn’t want to support anybody, but I’m glad she has come to that position and realization,” he said.

“I used to feel that way too before 2016 or so that I don’t have business in politics, but the business of politics is actually the biggest activism that has to be done to save society.”

He argued that activism and politics are interconnected and that those seeking societal improvement must engage directly in the political space.

Despite his disagreement over her party choice, Sowore said he still supports her ambition and wishes her success in the election.

“I totally support her, and I hope she wins, even though I think she’s in the wrong party. She should have joined our party,” he added.

“It’s a clear foul. You’re going to obviously get a lot of people saying they think it should have stood because it’s controversial… but I think it’s the right decision,” he said.

Rooney added that the arm across Raya’s face clearly affected his ability to contest the ball.

He also praised VAR for intervening in such a high-stakes moment, calling it an example of the system working properly in a major match.

“It’s the one time I actually think VAR has done a really good job in such an important game,” he noted.

The former striker also commented on what he sees as long-standing protection given to goalkeepers by referees.

He said he has often been frustrated during his playing days by how easily fouls are awarded in their favour.

Rooney argued that goalkeepers benefit from physical advantages in aerial duels and are often awarded free-kicks even in minimal contact situations, making the rules difficult for attackers.
