Tension In Court As Judge Sets June 15 For Ruling On EFCC Evidence In Yahaya Bello Case.

Justice Emeka Nwite set the date after listening to arguments from EFCC counsel, Kayode Enitan, SAN, and defence counsel, Adebayo Adedeji, SAN, on the legality of tendering the document.
The issue arose when the EFCC sought to tender the extra-judicial statement of its 14th prosecution witness (PW-14), Shehu Bello, during examination-in-chief.
Earlier in the proceedings, EFCC lead counsel, Kemi Pinheiro, SAN, informed the court that the day’s sitting was for continuation of PW-14’s testimony, adding that Enitan would lead the witness in evidence.
While testifying, the witness narrated his involvement in two property transactions in Abuja linked to Ali Bello. He told the court that he recommended a construction company, Metro Deck Construction Company Limited, which was later contracted to build a house.
He also stated that payments for the project were made through bank transfers and, on some occasions, in cash denominated in naira.
The witness further testified about another property at Plot 1058, Cadastral Zone A08, Wuse II, Abuja, explaining that he helped facilitate its acquisition for development purposes.
When questioned, PW-14 confirmed that he had previously made a statement to the EFCC and acknowledged his signature on all pages of the document.
However, when the prosecution moved to tender the statement, defence counsel Adebayo Adedeji objected, arguing that it was inadmissible as substantive evidence at that stage of the trial.
He contended that such extra-judicial statements could only be used by the defence to challenge a witness’s credibility, citing provisions of the Evidence Act and relevant Supreme Court decisions.
Adedeji further argued that the statement was not confessional and therefore could not be admitted against the defendant as proposed by the prosecution.
In response, EFCC counsel Enitan disagreed, describing the defence argument as lacking credible legal backing and based on a misinterpretation of the law.
After hearing both sides, Justice Nwite adjourned the matter to June 15 for ruling on the admissibility issue and June 18 for continuation of the trial.
Meanwhile, during a previous sitting, another prosecution witness had told the court that he had no property dealings with the former governor and only knew him as a public figure.
