He is asking the court to order his release and also seeking ₦500 million in damages for alleged violations of his fundamental rights.

The suit, filed under the Fundamental Rights Enforcement Procedure Rules of 2009, names the Attorney General of the Federation, the Chief of Army Staff, the Nigerian Army, and the Chief of Defence Intelligence as respondents. It questions why he has allegedly been held for several months without being charged in court.

Through his lawyer, Olalekan Ojo (SAN), Ma’aji argued that his prolonged detention without trial violates his constitutional rights to liberty and human dignity.

Court filings indicate that he was arrested around September 30, 2025, alongside others over allegations of involvement in a coup plot. Since then, he has reportedly remained in military custody in Abuja.

He further alleged that he has been denied access to his family, legal representatives, and adequate medical care during his detention.

The officer maintained that despite claims that investigations have been concluded, authorities have failed to formally charge him within the time required by law. He based his arguments on provisions of the 1999 Constitution and the African Charter on Human and Peoples’ Rights.

Among his requests, he is seeking a declaration that his detention is unlawful, an order for his immediate release, or alternatively, a directive compelling authorities to arraign him within seven days.

He is also demanding ₦500 million in compensation for the period he has allegedly spent in custody without trial.

An affidavit submitted by a litigation officer in his legal team stated that he has been completely cut off from communication since his arrest and has not been formally charged.

The court is yet to assign a date for the hearing of the case.
