Justice Emeka Nwite of the Federal High Court in Abuja has ordered the final forfeiture of $13 million linked to Lagos socialite Aisha Achimugu and her company, Oceangate Engineering Oil & Gas Ltd, to the Federal Government.

Delivering judgment on Wednesday, March 25, the court ruled that the funds were proven by the Economic and Financial Crimes Commission (EFCC) to be proceeds of fraud and unlawful activities.

The ruling followed a suit filed by Oceangate seeking to recover the funds. However, Justice Nwite held that the company failed to provide credible evidence to justify the source of the money, stating that it “failed woefully” to explain how it came about the $13 million.

He noted that the EFCC satisfied all legal requirements to classify the funds as illicit and warrant their forfeiture. The court also dismissed claims that the money was a gift received through Achimugu, pointing out that neither she nor any alleged donor appeared before the court to support the claim.

According to the judge, the burden of proof rested on the company, which it failed to discharge. He added that Oceangate could not demonstrate any legitimate business activity or customer payments that generated the funds, strengthening the EFCC’s case.

The court recalled that an interim forfeiture order was earlier granted on August 22, 2025, following an ex parte application by the EFCC, with a directive for publication inviting interested parties to show cause within 14 days.

In an affidavit, EFCC investigator Usman Aliyu detailed how the funds were allegedly tied to suspicious transactions, including payments for oil block acquisitions. He stated that Oceangate participated in the 2024 oil licensing bid and was required to meet financial obligations amounting to $37.2 million.

The commission alleged that the company used illicit channels, including unlicensed Bureau de Change operators and cash couriers, to move about $13 million outside the formal banking system. It further claimed that part of the funds originated from contractors linked to Lagos State Government projects and were later converted into dollars for oil block payments.

However, Oceangate, through its director Iliya Wakil, denied the allegations, insisting the funds were sourced from legitimate business earnings and gifts to Achimugu. The company maintained it had no involvement in unlawful transactions and argued that a licensed Bureau de Change operator was engaged to source the foreign exchange.

The EFCC countered these claims, describing the company as a shell entity allegedly used to channel illicit funds. It also challenged the credibility of the firm’s audit report, noting that the auditor did not review key financial records and confirmed that the company had not generated income from oil and gas operations.

After reviewing all submissions, Justice Nwite upheld the EFCC’s position and ruled that Oceangate failed to establish lawful ownership of the funds, ordering their final forfeiture to the Federal Government.

The judge had earlier ordered the forfeiture of an additional $7 million recovered from a bank account in Lagos after no claimant emerged.

The latest judgment effectively brings the prolonged legal dispute over the $13 million to a close, reinforcing the EFCC’s stance on the matter.
