According to reports, the Nigerian Bar Association (NBA) has raised concerns over an incident involving Justice Mohammed Umar of the Federal High Court in Abuja and lawyer Marshall Abubakar. The confrontation occurred on March 16 during a defamation trial in which Abubakar represented activist Omoyele Sowore.....KINDLY READ THE FULL STORY HERE▶

The judge reportedly ordered Abubakar to kneel in court after the lawyer allegedly spoke in a raised voice while discussing the suitability of a hearing date. Justice Umar is also said to have threatened to commit the lawyer for contempt.

In a statement, the NBA described the episode as deeply troubling, emphasizing its potential impact on the dignity of the legal profession and the sanctity of the courtroom. “The courtroom is a temple of justice, governed by law, procedure, and decorum,” the association said. It noted that while judges have authority to maintain order, such powers must be exercised within the bounds of law and judicial standards.

The NBA stressed that although courts can punish for contempt, this must follow defined legal procedures to ensure fairness and preserve the rights and dignity of all parties. The association added that ordering a legal practitioner to kneel is not a recognized judicial sanction under Nigerian law and does not align with expected judicial conduct.

The NBA further advised that any alleged contempt should be handled through proper legal processes. It reminded lawyers to maintain professionalism and decorum in court while vigorously advocating for clients. NBA President Afam Osigwe (SAN) urged calm and restraint, noting that grievances arising from courtroom incidents should be addressed through appropriate institutional and disciplinary channels. The association affirmed its readiness to engage relevant authorities to uphold the rule of law, professional standards, and judicial ethics.
