“Court Fines EFCC N5M Over Delay In Emefiele’s Trial”.
According to reports, a High Court of the Federal Capital Territory (FCT) sitting in Maitama has imposed a N500,000 fine on the Economic and Financial Crimes Commission (EFCC) for delaying the trial of former Central Bank of Nigeria (CBN) Governor Godwin Emefiele. Justice Muazu granted what he termed a final adjournment for the prosecution to present its witnesses. Emefiele faces a 20-count amended charge including alleged criminal breach of trust, forgery, abuse of office, conspiracy, and obtaining money by false pretence. Among the allegations is the fraudulent acquisition of $6.23 million allegedly intended for international election observers during the 2023 general election and the conferral of corrupt benefits on April 1616 Nigeria Limited and Architekon Nigeria Limited.
During the hearing, EFCC counsel Abba Mohammed (SAN) explained that the scheduled witness, Deputy Commissioner of Police Elohor Edwin Okpoziakeo, was absent due to attending a personal matter before another High Court in Gwagwalada involving a garnishee order on his bank account. Mohammed noted that he had contacted the Inspector-General of Police and met with the Assistant Inspector-General in charge of legal matters to secure the witness’s presence and requested an adjournment to allow the prosecution to present him.
Defence counsel Matthew Burkaa (SAN) opposed the request, citing sections 396(3) and (4) of the Administration of Criminal Justice Act (ACJA) 2015, which limit parties to five adjournments from arraignment to judgment. He argued that the prosecution had already taken eight adjournments and had sufficient time to prepare its witness.
Ruling on the matter, Justice Muazu acknowledged the ACJA limits but emphasized that the court retains discretion in the interest of justice. He stated that an investigator should not be excluded in a case of this magnitude. Relying on Section 396(6) of the ACJA, the judge awarded N500,000 costs against the prosecution for causing unnecessary delays and adjourned the case to April 27 and 28 for continuation of the trial.
