Gummi Back In Office After Appeal Court Ruling.

In a unanimous ruling on Friday, a three-member panel held that the lower court erred in declaring Gummi’s seat vacant due to his defection from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC).
The Federal High Court, presided over by Justice Obiora Egwuatu, had previously ruled that Gummi lost his seat after leaving the PDP, the party under which he was elected. Gummi represents the Gummi/Bukkuyum Federal Constituency of Zamfara State.
Gummi had cited the leadership crisis within the PDP, particularly at the national level, as the reason for his defection. He argued that the party’s internal conflicts hindered his ability to effectively represent his constituents and carry out his duties without interference.
Delivering the appellate court’s judgment, Justice Oyebiola Oyewumi stated that Gummi had the right to leave the PDP given the widely known crisis. She affirmed that political officeholders are entitled to seek a more stable platform if their current party becomes unstable.
The court allowed the appeal (CA/ABJ/CV/1606/2025) and set aside the Federal High Court ruling (FHC/ABJ/CS/1803/2024), which was filed by the PDP and its Zamfara State Chairman, Jamilu Jibomagayaki. Justice Oyewumi also awarded N1 million in costs against the PDP and Jibomagayaki in favour of Gummi.
